Oklahoma life insurance rights and regulations

The insurance industry in Oklahoma is regulated under Title 36 of the Oklahoma Statues. These codes outline claims procedures and policy requirements for the benefit of consumers and insurers alike.

One consumer protection lies in the 31-day grace period on late premium payments allowed by all Oklahoma life insurance companies. During this window, an insurer will not cancel a life policy, and coverage will continue uninterrupted so long as the account is brought current.

However, Oklahoma law extends some protections to insurers as well. Misrepresentation on a policy or application can be grounds for policy cancellation, and the insurer will refund premiums only at their discretion. Oklahoma insurance companies can contest any statement during the first two years of a policy.

If a misstatement of age is discovered, the insurer will reduce the benefits to reflect the actual age of the insured.

Oklahoma insurers are also allowed to follow their own claims procedure.

The Oklahoma Life Insurance Guaranty

If your life insurance company is licensed in Oklahoma, your policy is backed by the Oklahoma Life and Health Insurance Guaranty Association. This organization helps protect you, the insured, should your insurance company go bankrupt.

However, there are restrictions on this protection. In Oklahoma, compensation for lost death benefits is limited to $300,000, and compensation for lost cash surrender is limited to $100,000.
