North Carolina life insurance rights and regulations

The insurance industry in North Carolina is regulated under Chapter 58 of the North Carolina General Statutes. These statutes outline claims procedures and policy requirements for the benefit and protection of you, the consumer.

One such protection is the 10-day "free look" provision all North Carolina life insurance policies must carry. During this window, a new policyholder can choose to decline the coverage and still receive a full premium refund. This period is extended to 30 days on policies delivered through the mail, (and some insurers offer the longer trial period regardless). Check your new policy for details.

Another consumer protection requires insurance companies to allow a one-month grace period on late premium payments. An insurer will not cancel a life policy during this time, and coverage will continue uninterrupted so long as the account is brought current.

North Carolina law also obligates insurance companies to settle claims as quickly as possible. If a claim is not settled within 30 days of the insurer's receipt of necessary documentation, the benefits should begin accruing interest that will be included in the final payment.

Insurers should also honor policyholder requests for information used in underwriting decisions. However, the insurer can choose whether to release the information to you or to your physician.

But North Carolina law extends some protections to insurers, too. Insurance companies can contest information provided on an application or policy for the policy's first two years. If any misstatements are found, the coverage can be cancelled (and the paid premiums refunded).

North Carolina insurers are also exempt from having to honor claims made in the first two policy years where the cause of death is suicide.

The North Carolina Life Insurance Guaranty

If your life insurance company is licensed in North Carolina, your policy is backed by the North Carolina Life and Health Insurance Guaranty Association. This organization helps protect you, the insured, should your insurer go bankrupt.

However, there are restrictions on this protection. In North Carolina, compensation for all benefits, including cash values, is limited to $300,000 per insured individual.

And your insurer must be licensed in North Carolina to qualify for the guaranty's backing. To check the status of an insurer, you can call the North Carolina Department of Insurance at 1-800-546-5664.
