New Mexico life insurance rights and regulations

The insurance industry in the State of New Mexico is regulated under Chapters 59 & 59A of the New Mexico Statutes. These statutes outline claims procedures and policy requirements for the benefit of consumers and insurers alike.

One such regulated procedure is the settlement of life insurance claims. In New Mexico, these should be made upon receipt of proof of death, and finalized within two months.

However, every insurer may follow their own specific procedure, so look to the text of your life insurance policy for details.

New Mexico law also extends some protection to insurers. For example, misstatements on policies or applications can be grounds for policy cancellation. In these cases, the insurer is not obligated to honor any claims.

A misstatement of age will usually only result in the recalculation of benefits (based on the actual age of the insured).

The New Mexico Life Insurance Guaranty

If your life insurance policy is underwritten by a licensed insurance company, you qualify for the protection of the New Mexico Life Insurance Guaranty Association. This organization helps compensate policyholders in the event of insurer bankruptcy.

However, the protection does have restrictions. Compensation for lost death benefits in New Mexico is limited to $300,000, and compensation for cash surrender or withdrawal to $100,000. These limits are per insured, and hold even in the event of multiple policies with a higher total coverage.
