Kentucky life insurance rights and regulations

The life insurance industry in Kentucky is regulated under Title 25 of the Insurance Code of Kentucky. Under this title, claims procedures and policy requirements are overseen by the state in order to protect you, the consumer.

One such protection is the guaranteed 30-day grace period on late premium payments. All Kentucky life insurance companies are required to allow policyholders this window in which to make up a late payment, during which time their policy won't be cancelled.

However, the code extends some protections to insurers, too. Life insurance companies may challenge statements made on an application or policy for up to two years from the policy's effective date. Misstatements may result in policy cancellation (with a refund of premiums).

A misstatement of age can be discovered at any point during the life of the policy and the insurer will adjust the benefits to reflect the actual age of the insured.

The Kentucky Life Insurance Guaranty

If your life insurance company is licensed in Kentucky your policy is backed by the Kentucky Life and Health Insurance Guaranty Association. This organization will help protect you, the insured, should your insurance company go bankrupt.

However, there are restrictions on this coverage. In Kentucky, the maximum compensation for lost death benefits is $300,000 and the maximum compensation for cash surrender is $100,000.

And, in order to qaulify for this protection, your insurer must be licensed in Kentucky. You can check your insurance company's status with the Kentucky Department of Insurance at 1-800-595-6053.
