Kansas life insurance rights and regulations
The insurance industry in the State of Kansas is regulated under Chapter 40 of the Kansas Statutes. Under this chapter, claims procedures and policy requirements are overseen by the state in order to protect you, the consumer.
One such protection lies in the required 30-day grace period for late payments, which all Kansas life insurance companies allow. A life policy cannot be cancelled for the first 30 days late, and it will continue without interruption upon receipt of the late payment.
However, the statues provide some protections for insurers, too. Misstatements about medical history can be grounds for policy cancellation (and the refund of paid premiums). However, if the insured's age is misstated, the company will usually simply recalculate the benefits based on the correct age.
In Kansas, death by suicide is generally not covered during the first two years of a life insurance policy. Any such claim will only result in a refund of premiums. The Kansas Life Insurance Guaranty Association Most Kansas life insurance policyholders are offered some guarantee of protection by the Kansas Life and Health Insurance Guaranty Association. This organization helps cover policies in the event of an insurance company insolvency.
However, there are some restrictions on this protection. In Kansas, the compensation for lost death benefit proceeds may not exceed $300,000 per insured individual, and the net cash withdrawal cannot exceed $100,000. These limits stand even if an insured owns multiple policies with higher total coverage amounts.
